1. Who We Are

This Privacy Policy explains how Cherries Cars LLC ("we," "us") collects, uses, shares, and protects personal information when you use the Cherries application and website (the "App"). Cherries Cars LLC is the operator of the App and the entity responsible for your personal information.

For users in the European Economic Area (EEA), the United Kingdom, and Switzerland, Cherries Cars LLC is the data controller of your personal information. Our contact details are in Section 13.

2. Information We Collect

Information you provide:

• Account data: name, email, username, password, profile details.
• Phone number (optional): if you enter one during onboarding, or as a contact number on an insurance report, we store it as a contact detail only. It is never used to sign in, to verify or recover your account, or to send text messages. It is deleted with your account, and you can ask us to remove it sooner using the contact details in Section 13.
• Consent and acceptance records: when you accept our Terms or give or withhold a consent (for example, marketing or an arbitration opt-out), we may keep a record of the acceptance, including the date and time, your IP address, browser/user-agent, and the version of the terms you accepted.
• Push notification data: if you enable push notifications, we store your device's push subscription (the delivery endpoint and its encryption keys) and your opt-in status, so we can send the notifications you request. Disabling notifications deletes the subscription.
• Garage data: vehicles, specifications, photos, maintenance and ownership records you enter.
• Community data: posts, comments, likes, and messages you submit to the feed.
• Payment data: handled by our payment processors; we receive limited billing confirmation, not full card numbers.
• Support data: information you share when you contact us.

Information collected automatically:

• Device and usage data: IP address, device type, operating system, app version, identifiers, pages/screens viewed, and interactions.
• Cookies and similar technologies (see our Cookie Policy).
• Approximate location derived from IP address (and precise location only if you grant permission).

Information from AI features:

• The prompts, queries, and inputs you submit to AI Features, and the outputs generated, may be processed and retained to operate and improve the Service.

3. How We Use Your Information

We use personal information to:

• create and manage your account and provide the App's features (garage, valuations, research, community);
• generate valuations and AI outputs you request;
• operate, secure, troubleshoot, and improve the App;
• personalize content and recommendations;
• communicate with you about your account, updates, and (with consent where required) marketing;
• process payments and manage subscriptions;
• detect, prevent, and address fraud, abuse, and violations of our Terms; and
• comply with legal obligations.

4. Legal Bases for Processing (EEA/UK)

Where GDPR or UK GDPR applies, we rely on the following legal bases:

• Contract — to provide the App and features you request.
• Consent — for marketing, non-essential cookies, and precise location; you may withdraw consent at any time.
• Legitimate interests — to secure, improve, and promote the App, balanced against your rights.
• Legal obligation — to comply with applicable law.

5. How We Share Information

We do not sell your personal information for money. We may share it with:

• Service providers (hosting, analytics, payment processing, AI providers, customer support) under contracts that restrict their use of the data;
• Other users, for the Garage and Community content you choose to make public;
• Legal and safety recipients, where required by law or to protect rights and safety; and
• Business transfers, in connection with a merger, acquisition, or sale of assets.

We do not share personal information for advertising, and we do not engage in "sales" or "sharing" of personal information as defined by US state privacy laws — see Section 9. If that ever changes, we will update this Policy and provide the legally required opt-outs first.

6. AI Providers and Automated Processing

The App uses AI Features that may rely on third-party AI service providers to process your inputs. We share only what is needed to generate the requested output. AI outputs are estimates and may be inaccurate; we do not use them to make legally significant decisions about you without a lawful basis, and you can contact us about any automated processing concerns.

7. International Data Transfers

We may transfer and process personal information in countries other than where you live, including the United States. Where required, we use safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum) to protect transfers from the EEA/UK. You may request a copy of the relevant safeguards using the contact details below.

8. Data Retention and Account Deletion

We retain personal information for as long as needed to provide the App, comply with legal obligations, resolve disputes, and enforce our agreements. Garage and Community content persists until you delete it or close your account.

Account deletion (see also Section 17 of our Terms and Conditions):

• Before deleting your account, you can export your garage data and records using the App's export features. Deletion is permanent, so export anything you want to keep first.
• When you delete your account (or we terminate it), your account and personal information are deleted within 30 days, subject to the exceptions below.
• Your public feed posts and comments are removed from public view; copies that other users have shared or stored, and content needed for the integrity of other users' threads, may persist as described in the Terms.
• Residual copies may remain in encrypted backups for a limited period until those backups age out in the ordinary course.
• We retain records we are legally required to keep — for example payment and tax records, consent and acceptance records, and records related to disputes — for as long as the law requires.
• If your account is suspended rather than deleted, its data is retained so the account can be reviewed or restored; suspension does not start the deletion clock. You may still request deletion of a suspended account, subject to our legal retention needs.

Nothing in this Section limits your rights under Section 9, including your GDPR/UK GDPR erasure and portability rights; where those rights apply on different terms, they control.

9. Your Privacy Rights

EEA / UK / Switzerland (GDPR): You have the right to access, rectify, erase, restrict, or object to processing of your personal information, to data portability, and to withdraw consent. You may also lodge a complaint with your local supervisory authority (in Germany, this is your state Data Protection Authority).

California (CCPA/CPRA) and similar US state laws: You have the right to know, access, delete, and correct your personal information, to opt out of "sale" or "sharing" and targeted advertising, to limit use of sensitive personal information, and not to be discriminated against for exercising these rights. We do not sell your personal information and do not use it for cross-context behavioral (targeted) advertising, so no separate opt-out is required; you may still contact us at info@cherriescars.com to exercise any applicable right. We honor Global Privacy Control (GPC) signals where required.

All users: You may exercise rights by contacting us at info@cherriescars.com. We will verify your request and respond within the timeframes required by law. You may use an authorized agent where permitted.

10. Children's Privacy

The App is not directed to minors. You must be at least 18 years old — or the age of majority in your jurisdiction, whichever is greater — to use the App (see Section 3 of our Terms and Conditions). This is because the App offers paid subscriptions, valuation and market-data tools intended for adults, a public community feed, and terms that include a binding arbitration agreement.

We do not knowingly collect personal information from anyone under 18. If we learn that an account belongs to someone under 18 (or under the applicable age of majority), we will terminate the account and delete its personal information. If you believe a minor has provided us information, contact us at info@cherriescars.com and we will delete it.

11. Security

We use technical and organizational measures designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Changes to This Policy

We may update this Policy from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide additional notice.
